CONSERVATION EASEMENTS PROVIDE SIGNIFICANT FLEXIBILITY
An easement imposed on real property containing uncommon wildlife habitat may impose restrictions on development, while one granted on agricultural land may permit ongoing farming activities and the construction of agricultural structures. Conservation easements can be tailored to apply to specific portions of the property and are not obligated to provide public access. Establishing a conservation easement offers various flexible options. Non-profit entities such as land trusts or other public agencies are typically engaged in negotiating and enforcing these restrictions.
Upon donation of a qualified conservation easement, a landowner may be eligible to claim an income tax deduction based on the appraised value of the surrendered rights.
